Tennessee just introduced a bill that would establish a new type of marriage - one that would not have any minimum age requirements. HB 0233 was introduced by Tom Leatherwood a Republican, in February, and has slowly made its way through the legislature since then. The bill would enshrine the concept of common law marriage into law, which is a legally recognized marriage that is automatically granted to couples that meet certain cohabitation requirements. In this case, the bill seeks to define common law marriage as a union between one man and one woman.
If a county clerk decided in favor of granting a minor a marriage license, that clerk would have the state of Tennessee on their side if someone were to bring a suit against them.
