Attorney Steve 2019 Torrent Litigation Updates - Can Strike 3 overcome fully the effects of the Cobbler Nevada case?
In this episode of Vondran Legal Hour, Attorney Steve® discusses Bittorrent lawsuits and a potentially new litigation strategy by one of the premier filer of Copyright Infringement lawsuits in the United States - Strike 3 Holdings. Malibu Media, LLC has a similar litigation model that seeks to enforce their clients adult ographic movies (ex. X-Art, Tushy, Vixen, or Blacked) and to seek what many refer to as "shame settlements" often having to pay over $10,000 dollars or more to settle a case of alleged online copyright infringement. Lately, we have seen what appears to be a new strategy by Strike 3 to (what in my opinion is an attempt to deal with the rough holding of the Cobbler Nevada case) and they are searching an alleged defendants social media profiles to see what they claim publicly to be interested in. One I saw was Jimmy Kimmel show, meaning, the argument seems to be (made to the court) is that because someone watches a handful of movies or shows (they are interested in - a big list of shows was provided in one complaint I reviewed), this can predict or somehow indicate that the person is more likely to be an infringer or their products. This does not sound like an argument based on facts, but more on pure speculation. We will see how the Court views these arguments. Is it the "something more" Plaintiffs need to allege to avoid a Rule 12(b) motion to dismiss?
