Welcome to another exciting episode of Vondran Legal Hour!  This episode deals with theft of intellectual property, and more specifically, copyright infringement of a book idea, screenplay, or other creative work.

Proving Copyright Infringement

A Plaintiff in a copyright infringement action must allege and prove:

1. Ownership of a copyrighted work (ex. music, film, lyrics, screenplay, reality show concept)

2.  Defendant had "access" to the copyrighted work

3.  Defendant "substantially copied" the copyrighted work (or made a derivative work, etc.)

If a Plaintiff can show "striking similairites" this may help them overcome a lack of proof in the other areas.
