FDR invoked Emergency Powers his first day in office. He went on to further strengthen the Emergency Powers Act so that those powers would remain available to all future Presidents should they decide to keep and/or use them. All Presidents since chose to keep with some putting them to use. 470 Laws are currently on the books by Presidential decree. Making law is reserved for the Legislative branch which is powerless (by choice) to remove the Emergency Powers declared.
